Except for disputes eligible for small claims court or claims seeking injunctive relief for intellectual property misuse, any dispute arising out of or relating to these Terms or the website shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its applicable consumer arbitration rules.

The arbitration shall take place in California, unless the parties agree to remote arbitration or another location. The arbitrator shall have authority to award individual relief available under applicable law.

15.4 Small Claims Exception

Either party may bring an individual claim in small claims court if the claim qualifies and remains only in that court.

15.5 Class Action Waiver

You and Commerce Troop agree that disputes shall be brought only on an individual basis and not as a class action, collective action, consolidated action, private attorney general action, or representative proceeding.

16. Severability

If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable, or, if modification is not possible, severed from these Terms.

17. No Waiver

Commerce Troop’s failure to enforce any provision of these Terms does not waive its right to enforce that provision later.

18. Entire Agreement
