Either party may bring an individual claim in small claims court if the claim qualifies and remains only in that court.
15.5 Class Action Waiver
You and Commerce Troop agree that disputes shall be brought only on an individual basis and not as a class action, collective action, consolidated action, private attorney general action, or representative proceeding.
16. Severability
If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable, or, if modification is not possible, severed from these Terms.
17. No Waiver
Commerce Troop’s failure to enforce any provision of these Terms does not waive its right to enforce that provision later.
